1. Agreement
These Terms of Service ("Terms") are a binding agreement between you and PureBariatric ("we", "our") governing your access to and use of the PureBariatric mobile and web application ("the App") and the websites at purebariatric.app and purebariatric.com (collectively, "the Services"). By installing, opening, or using the Services, you agree to these Terms.
2. Educational use only
The Services provide general educational information and tracking tools for people recovering from bariatric surgery. The Services are not a medical device. The Services do not diagnose, treat, cure, or prescribe. They do not replace the advice of your surgeon, dietitian, family physician, or any other licensed healthcare professional.
Always follow your own clinical team's instructions. If they conflict with anything in the Services, follow your clinical team.
3. Eligibility
You must be at least 18 years old to use the Services. The Services are intended for adults recovering from, or preparing for, bariatric surgery.
4. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the Services on devices you own or control, for your own non-commercial use. You may not copy, modify, reverse-engineer, distribute, or create derivative works of the Services except as expressly permitted by law.
5. User content
Any content you enter into the App — food log entries, hydration data, supplement entries, photos used in the optional Photo Food Log — remains yours. As described in our Privacy Policy, this content is stored on your device and is not uploaded to PureBariatric servers in v1.0.
6. Third-party services
The optional Photo Food Log feature uses a third-party AI service, Passio Inc. (United States — passio.ai). Your use of that feature is also governed by Passio's Terms and Privacy Policy. The feature is off by default and can be enabled only with your consent.
Distribution of the App through Apple's App Store is also governed by Apple's standard end-user license agreement for licensed applications.
7. Medical disclaimer
The Services are not designed to detect, diagnose, monitor, treat, cure, prevent, or alleviate any disease, injury, or disability. The Services are not a substitute for professional medical advice, diagnosis, or treatment. If you experience uncontrolled vomiting, signs of dehydration, fever, severe abdominal pain, chest pain, shortness of breath, or any other concerning symptom, contact your surgical team or local emergency services immediately.
8. Disclaimer of warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL PUREBARIATRIC, ITS FOUNDERS, OFFICERS, OR AFFILIATES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO ONE HUNDRED CANADIAN DOLLARS (CAD $100).
10. Indemnification
You agree to defend, indemnify, and hold harmless PureBariatric from any claim, liability, damage, loss, or expense, including reasonable legal fees, arising out of your breach of these Terms or your misuse of the Services.
11. Termination
You may stop using the Services and uninstall the App at any time. We may suspend or terminate your access if you breach these Terms or use the Services in a manner that creates legal or operational risk for us or other users.
12. Changes
We may update these Terms from time to time. When we do, we will update the "Last reviewed" date at the top of this page. Material changes will be summarized inside the App on next launch.
13. Governing law
These Terms are governed by the laws of the Province of Alberta, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. The courts located in Alberta will have exclusive jurisdiction over any dispute arising from these Terms or the Services, except where mandatory consumer-protection laws of your jurisdiction of residence provide otherwise.
